FORCE TURBOS – TERMS OF SERVICE

1. OVERVIEW & ACCEPTANCE OF TERMS

This website is operated by Force Turbos LLC (“Force Turbos,” “we,” “us,” or “our”).
By accessing our website, purchasing products directly from us, or purchasing Force Turbos products through any authorized or unauthorized third-party retailer, dealer, distributor, or reseller, you agree to be bound by these Terms of Service (“Terms”), including all policies referenced herein.

These Terms apply to all users, including browsers, customers, dealers, resellers, merchants, and contributors of content.

If you do not agree to these Terms, you may not access the website or purchase or use Force Turbos products.

2. HIGH-PERFORMANCE PRODUCT NOTICE

Force Turbos designs and sells high-performance, off-road, racing, and competition products intended for experienced users.

These products:

Are not consumer retail goods
Are not street-legal unless expressly stated
Operate under extreme conditions
May increase risk of vehicle damage, engine damage, personal injury, or death

Purchaser assumes all risks associated with selection, installation, tuning, use, resale, or operation.

3. NO WARRANTY – SOLD AS-IS

Unless expressly stated in writing by Force Turbos:

All products are sold AS-IS
NO WARRANTIES are provided, express or implied
This includes, without limitation:
- Merchantability
- Fitness for a particular purpose
- Performance, durability, compatibility, or results

Force Turbos does not guarantee horsepower gains, reliability, engine life, or vehicle longevity.

4. THIRD-PARTY PURCHASES (CRITICAL)

If you purchase a Force Turbos product from any third-party retailer, dealer, distributor, marketplace, or reseller:

These Terms of Service still apply
Force Turbos’ warranty, return, and liability policies govern
No third party is authorized to alter, expand, or modify Force Turbos’ terms
Any representations made by third parties are not binding on Force Turbos

Purchases through third parties do not create a separate warranty or contractual obligation beyond these Terms.

5. LIMITED RETURN POLICY (UNUSED / UNINSTALLED ONLY)

Force Turbos offers a strict 14-day return window from delivery only if all conditions are met:

Return Eligibility:

Product must be unused, uninstalled, unmodified
Original packaging, components, and documentation intact
Proof of purchase required
Written authorization required before return

Installed, used, test-fit, powered, tuned, or modified products are FINAL SALE.

Shipping costs, transaction fees, labor, and processing fees are non-refundable.

6. SHIPPING, DELIVERY & RISK OF LOSS

Transfer of Risk

Force Turbos’ fulfillment obligation ends once the shipment is scanned and accepted by the carrier.

At that moment:

Title and risk of loss transfer to the customer
Delivery, theft, or misdelivery is outside Force Turbos’ control

Optional Shipping Protection

Force Turbos offers optional Shipping Protection at 5% of the invoice total.

Coverage applies only if purchased at checkout and covers:

Lost shipments
Stolen shipments
Packages marked “Delivered” but not received

If Shipping Protection is declined, Force Turbos is not responsible for theft, loss, or non-delivery.

Carrier delivery confirmation, GPS scans, and delivery photographs constitute conclusive proof of delivery.

False claims of non-delivery may be treated as fraud.

7. BILLING, ORDERS & CANCELLATIONS

We reserve the right to refuse, cancel, or limit any order.

You agree to provide accurate billing and shipping information.
Orders suspected of fraud, abuse, resale manipulation, or chargeback risk may be canceled.

8. CHARGEBACKS & PAYMENT DISPUTES

By purchasing, you agree:

Not to file chargebacks for policy-compliant transactions
That delivery confirmation fulfills our obligation
That dissatisfaction, theft, misuse, or installation error is not grounds for reversal

Force Turbos may:

Contest chargebacks
Recover fees and administrative costs
Permanently ban abusive customers

9. DISCLAIMER OF LIABILITY

To the maximum extent permitted by law, Force Turbos shall not be liable for:

Vehicle damage
Engine failure
Loss of use
Loss of profit
Personal injury or death
Consequential or incidental damages

Total liability, if any, shall not exceed the purchase price of the product.

10. ASSUMPTION OF RISK & INDEMNIFICATION

You expressly assume all risks associated with:

Installation
Modification
Tuning
Operation
Resale

You agree to indemnify and hold harmless Force Turbos from any claims arising from use or misuse of its products.

11. PROHIBITED USES

You may not:

Use products unlawfully
Misrepresent Force Turbos products
Submit false claims
Engage in fraud, abuse, or chargeback manipulation

Violations may result in account termination and legal action.

12. INTELLECTUAL PROPERTY

All content, designs, data, and materials are the exclusive property of Force Turbos and may not be reproduced without written consent.

13. TERMINATION

Force Turbos may terminate access or refuse service at any time for violations of these Terms.

14. GOVERNING LAW

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.

15. SEVERABILITY

If any provision is found unenforceable, the remainder shall remain in full force.

16. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Force Turbos and supersede all prior agreements or representations.

17. CALIFORNIA PROPOSITION 65 WARNING

Incorporated Policies & Priority of Terms

These Terms of Service expressly incorporate by reference the following Force Turbos policies (collectively, the “Policies”):

Privacy Policy
Any additional policies posted on the Force Turbos website

In the event of any inconsistency, these Terms of Service control, followed by the Return & Warranty Policy, then the Shipping & Shipping Protection Policy.

By purchasing products directly from Force Turbos or through any third-party retailer, the customer acknowledges that all purchases and product use are governed by these Terms and Policies, regardless of point of sale.

Acceptance of any one policy constitutes acceptance of all incorporated policies.

This clause prevents customers from:

Cherry-picking a single page
Claiming ignorance of shipping or return rules
Arguing third-party sellers override your terms

Product is unused, uninstalled, and unmodified
Original packaging, components, and documentation intact
Proof of purchase required
Prior written authorization required

Any product that has been installed, test-fit, powered, tuned, or used in any manner is FINAL SALE.

NON-RETURNABLE ITEMS

The following are non-returnable and non-refundable:

Installed or used products
Custom or special-order items
Tuned, programmed, or electronic components
Sale or clearance items
Gift cards
Hazardous or regulated materials

THIRD-PARTY PURCHASES

If you purchase a Force Turbos product from a dealer, distributor, marketplace, or reseller:

This Return & Warranty Policy still applies
Third parties may not modify or expand Force Turbos’ return or warranty terms
Any representations made by third parties are not binding on Force Turbos

RETURN PROCESS

Include order number, item(s), and reason
Unauthorized returns will be refused

Customer is responsible for return shipping costs.
Shipping, transaction fees, and labor are non-refundable.

DAMAGED OR INCORRECT ITEMS

Damage or incorrect shipment must be reported within 48 hours of delivery with photos.

CHARGEBACK NOTICE

Returns outside this policy are not eligible for refunds.
Chargebacks filed in violation of this policy may be contested and treated as abuse.
